Supreme Court rules states can force online retailers to collect sales tax

On Thursday, the Supreme Court agreed to overturn those decisions in a 5-4 ruling. Lawmakers have avoided the issue for years, in part because they didn't want to be seen increasing taxes, but the court's decision may give them cover to finally establish a coherent set of rules.

In addition to being a win for states, the ruling is also a win for large retailers, who argued the physical presence rule was unfair.

Many large online retailers, including Amazon and Wal-Mart, already collect sales taxes because they have a large enough physical presence in each state to qualify as taxable by states. They only had to collect it when shipping the product to a state where the company had a physical presence - like a store or warehouse.

President Donald Trump has also criticized Amazon, whose founder Jeff Bezos also owns the Washington Post, saying that it does not collect any sales tax.

However, under the new ruling, NY consumers would have to pay sales tax even though Newegg has no physical storefront in the Empire state. However, smaller e-tailers like Newegg used to have a no-tax advantage. According to the the Texas Tribune, Texas stands to gain hundreds of millions of dollars in tax revenue, making up for the estimated $1.1 Billion lost in uncollected sales tax every year. But in a concurrence, Kennedy acknowledged the "startling revenue shortfall" suffered by the states because of the court's Quill decision and invited them to try to find a better case in which to present the issue to the high court.

IN lawmakers anticipated the ruling in 2017 when they passed a law that imposed sales tax on companies that did at least $100,000 worth of business or more than 200 separate transactions in the state in a year.

The U.S. Supreme Court's decision about online sales tax is viewed as a win for states - but those with aggressive collection policies, such as NY and California, could face challenges from online retailers. Alaska, Del., Mont., N.H. and Ore...won't be affected by the Supreme Court's ruling.
