Apple Wants $1 Billion From Samsung In Damages Retrial

The original trial, back in 2012, awarded Apple $1.05 billion in damages, which was less than half of their ask of $2.75 billion.

"It took Apple several years and over a $1 billion to develop the iPhone", Lee told the jury.

The case is Apple v. Samsung Electronics Co., 11-cv-01846, US District Court, Northern District of California (San Jose).

The retrial for the 7-year-old design patent suit between Samsung and Apple will commence Monday in California, local time.

After a round of appeals, Koh lopped $405 million off the jury's original damages award, ordering Samsung to pay up to the tune of $548 million. The jury now has to decide whether the South Korean company should have to pay damages on the entire iPhone or just the components it infringed on.

"It could be that Samsung wants to prove a point that patents shouldn't be overused", Risch said.

Samsung attorneys, according to Bloomberg, argued this week that the damages should be paid based exclusively based on three "narrow" design patents - which would amount to $28 million.

For his part, Joswiak today opened by saying that Steve Jobs built Apple around a central theme of design while showing the jury photos of Apple products. He further added and said "Apple's design patents do not cover the entire phone". Koh has forbidden that argument on the ground that Samsung didn't raise it in the previous trial or on appeal. Whereas Samsung is fighting that it should give a lesser value for a portion of the iPhone's value. Susan Kare, a GUI designer who was part of Apple's Macintosh design team and has since worked for Microsoft and IBM, will testify that the iPhone GUI can not be separated conceptually from the phone. The design patents that Samsung infringed concern the physical shape that would become the iPhone, the bezel, and the colorful grid of icons.
