Stepfather charged with 1st-degree murder in death of boy, 6

Investigators determined that Montgomery had punched Brice in the face, mouth and stomach with a closed fist, threw him around the motel room and shoved the boy's face into the carpet.

Authorities said Montgomery threatened to beat Brice's siblings if they did not join the attack.

Medics with Hillsborough Fire Rescue said Brice was cold to the touch when they found him and starting to show signs of rigor mortis, the Herald reported.

'(Montgomery) picked him up and flung him as described by the other brothers, helicopter across the hotel room into what's kind of a cabinet, where he hit head first. Montgomery told police he only threw Brice onto a bed and the child hit his head on the headboard. And ultimately caused his brain to bleed, ' Smith said, noting how this caused the little boy to die within seconds or minutes.

Mr. Montgomery denied knowing Brice was "seriously hurt or dead" before he tried to wake him up, the affidavit said.

The incident took place around 1:00 a.m.at the Masters Inn in Seffner where the family lives.

Brice's mother, Donya Shenita Russell, was working a double shift at the time, according to Smith.

A hotel employee called police after midnight, alerted by a guest in Room 207 anxious about the wife and children next door after hearing a man yelling things such as "beat the kid", "push the kid over here", and "get his ass up".

The next morning, Montgomery called 911 to report that his stepson was not breathing. The boy was pronounced dead at 10.59am. When a Hillsborough County Sheriff's Office deputy went to Room 205, the arrest report said, Montgomery said the noise came from his music.

The children saw their stepfather pick up Brice by the leg and throw him against a shelf on the wall, the arrest report said.

According to WFTS, the Medical Examiner's Office determined Brice's death was a result of homicidal violence. They said Brice was bleeding from the nose and mouth and did not awake after that.

He then pushed the door open wide enough for the deputy to see the children sleeping in a bed towards the back of the motel room.

Hillsborough County Sheriff's Office deputies wrote in an arrest warrant for Montgomery that he and four children were staying in an extended stay hotel room in Seffner, Florida, around midnight on December 30, when a guest in a neighboring room told a hotel manager she heard loud yelling coming from Montgomery's room. It was not immediately clear whether Mr. Montgomery, who was being held on $870,000 bond, had a lawyer.
